GENERAL TERMS AND CONDITIONS OF USE AND SALE
Article 1 – Purpose
These general terms and conditions of use and sale (hereinafter “General Terms and Conditions”) govern all contractual relations established between Global Health Academy, a trade name operated by Saïd Mazid, an independent entrepreneur registered under business number 0815337359, with its registered office at 158 Chaussée d’Enghien, 1480 Saintes, Belgium, and any individual or legal entity accessing the services offered by Global Health Academy (hereinafter “User” or “Client”). These General Terms and Conditions cover online services, in-person workshops and seminars, and other products or services marketed by Global Health Academy, whether accessed for free or through registration and prior payment.
These General Terms and Conditions constitute the sole contractual framework applicable, to the exclusion of any other document, including the Client’s general purchasing terms or any other text issued by the Client, unless expressly agreed in writing by Global Health Academy. They are drafted in accordance with the provisions of the Belgian Civil Code, the Code of Economic Law, and any applicable regulations in force in Belgium, and take precedence over any prior version. Any order, registration, or use of a service implies the full and complete acceptance of the User of these General Terms and Conditions.
Article 2 – Registration and access to services
Access to the training sessions and events organized by Global Health Academy is strictly subject to prior registration and full payment of the corresponding fees. In accordance with Articles 1123 and following of the Belgian Civil Code, registration is reserved for individuals with full legal capacity, or, for legal entities, to duly authorized representatives.
The User is solely responsible for the accuracy and truthfulness of the information provided during registration. Any false statement or omission that could affect the registration process may result in the immediate suspension of access to the services, without prejudice to Global Health Academy’s right to claim damages. The information provided by the Client must be kept up to date; any changes must be communicated to Global Health Academy without delay.
The User may subscribe to an annual membership that offers discounts on services billed individually. This membership is automatically and tacitly renewed unless canceled by the Client via email to contact@ghacademy.eu at least seven days before the renewal date. The cancellation will take effect at the end of the current period. Failure to cancel within the required time frame will result in the automatic renewal of the membership under the same financial terms.
Article 3 – Pricing and payment terms
The prices for services are listed in euros, all taxes included, in accordance with Article VI.46 of the Code of Economic Law. Payments must be made in advance at the time of registration through one of the following payment methods: credit or debit card, bank transfer, or Bancontact. Global Health Academy reserves the right to refuse any order in the event of an unresolved prior dispute with the Client or non-payment.
For subscription to a membership, automatic billing is processed via Stripe on the anniversary date of the subscription. The Client guarantees that they have the necessary authorization to use the selected payment method. Any payment incident will result in the suspension of access to the services until the situation is fully resolved. Discount codes issued by Global Health Academy are personal, non-transferable, and can only be used according to the terms expressly stated at the time of issuance.
Article 4 – Medical liability disclaimer
The information provided on the platform and during Global Health Academy events is for informational purposes only and can in no way be construed as medical advice or a therapeutic consultation, in accordance with the law of May 10, 2015, on health professions. Global Health Academy disclaims any liability for misinterpretation or misuse of the information provided.
No professional-patient relationship is established between Global Health Academy and the User by the use of the services or participation in an event. Consequently, the User is solely responsible for any decision or action taken based on the information provided and is encouraged to consult a qualified health professional for any medical or health-related questions. Global Health Academy cannot be held liable for the consequences of any incorrect or incomplete interpretation of the information provided through its services.
Article 5 – Right of withdrawal and refunds
In accordance with Article VI.47 of the Code of Economic Law, the Client has a 14-day withdrawal period from the conclusion of the contract, without having to provide a reason. To exercise this right, the Client must send written notification to Global Health Academy via email to contact@ghacademy.eu. If the service has been partially used during the withdrawal period, Global Health Academy reserves the right to charge a proportional amount for the services already provided.
Beyond the withdrawal period, no refund will be granted, except in cases of force majeure, as defined by Article 1148 of the Belgian Civil Code. Any late or unjustified refund request will be automatically rejected, and Global Health Academy will not be held liable for the financial consequences resulting from this decision.
Article 6 – Cancellation of in-person events
Global Health Academy reserves the right to cancel any in-person event, including seminars and workshops, for operational, logistical, or force majeure reasons, with a minimum notice of 72 hours before the start of the event. Participants will be immediately informed of the cancellation via email and will have the option of a full refund or rescheduling their registration to another date, subject to availability. No additional compensation may be claimed, except in cases of gross negligence attributable to Global Health Academy.
Article 7 – Force majeure
Neither party shall be held liable for the non-performance or delay in the performance of its contractual obligations in the event of force majeure, as defined by Article 1148 of the Belgian Civil Code. Force majeure events include, but are not limited to, natural disasters, pandemics, acts of terrorism, strikes, communication network outages, and any other situation beyond the parties’ reasonable control.
Article 8 – Account security and confidentiality
The User is solely responsible for the security and confidentiality of their login credentials. Any unauthorized use of the account is the responsibility of the User. Global Health Academy reserves the right to suspend or terminate the account in the event of a breach of these General Terms and Conditions, without prior notice or compensation.
Article 9 – Image rights and intellectual property
The content made available by Global Health Academy, including texts, graphics, videos, and training materials, is protected by the law of June 30, 1994, on copyright and related rights. Any unauthorized reproduction, dissemination, or exploitation constitutes an infringement and may result in legal action. The User agrees to respect intellectual property rights and not to use the content for commercial purposes without prior written authorization.
Article 10 – Personal data and confidentiality
Global Health Academy processes Users’ personal data in compliance with Regulation (EU) 2016/679 (GDPR) and the Belgian law of July 30, 2018, on data protection. Data is kept only for the time necessary to achieve the purposes for which it was collected, in accordance with Article 5 of the GDPR. The User has the right to access, rectify, delete, and object to their data, which they can exercise at any time by contacting customer service at contact@ghacademy.eu.
Article 11 – Service interruptions and liability
Global Health Academy reserves the right to temporarily interrupt access to services for maintenance or updates, with a maximum downtime of 7 days. Global Health Academy will not be held liable for service unavailability, except in cases of gross or intentional fault, in accordance with Article 1147 of the Belgian Civil Code.
Article 12 – Modifications and termination
Global Health Academy reserves the right to unilaterally modify these General Terms and Conditions. Modifications will be notified with a 30-day notice before their effective date. The User may terminate their subscription free of charge before the effective date of the changes.
Article 13 – Jurisdiction and applicable law
These General Terms and Conditions are governed by Belgian law. In the event of a dispute concerning the interpretation or execution of the contract, jurisdiction is exclusively assigned to the courts of Brussels, in accordance with Article 624 of the Belgian Judicial Code. In the event of any inconsistency between different versions of these General Terms and Conditions, the French version shall prevail.
Article 14 – Severability and non-waiver
If any provision of these General Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The failure of Global Health Academy to enforce any provision of these General Terms and Conditions at any time shall not be interpreted as a waiver of its right to enforce it in the future.
